These Terms and Conditions (“Terms”) govern your use of the NeverMissAMessage service (“the Service”), operated by Stephen Popkin trading as NeverMissAMessage, Nottinghamshire, United Kingdom (“we”, “us”).
By signing up for the Service you agree to these Terms. Please read them carefully.
NeverMissAMessage provides an AI-powered WhatsApp assistant that handles inbound customer enquiries on behalf of your trade business. The assistant collects lead information (name, job description, location, preferred callback time) and sends that lead to you via WhatsApp.
The Service does not:
You remain responsible for all follow-up with your customers once a lead is delivered to you.
NeverMissAMessage operates on the official WhatsApp Business Platform. Use of the service is subject to WhatsApp’s Business Terms of Service and Commerce Policy. The AI assistant is a lead capture tool only and does not book jobs, provide quotes, or make commitments on behalf of the trade business. All final decisions, pricing, and appointments are made directly between the customer and the trade business.
The Service is available to UK-based trade businesses only. By signing up you confirm that you are operating a legitimate trade business in the United Kingdom and that the information you provide is accurate.
A one-off setup fee of £249 is charged at the time of onboarding. This fee covers the configuration and launch of your AI assistant, and includes your first month of service. The setup fee is non-refundable once your assistant has been built and tested.
We aim to have your assistant live within 24–48 hours of receiving your completed signup details. We will contact you if we need additional information.
The monthly subscription fee is £29 per month. Your first month is included in the setup fee. Recurring billing of £29/month begins 30 days after your assistant goes live.
Payment is processed via Stripe. By providing your payment details you authorise us to charge the monthly fee on a recurring basis until you cancel.
There is no minimum contract term. You may cancel at any time (see Section 6).
We reserve the right to change the subscription price. We will give you at least 30 days’ written notice before any price change takes effect. If you do not wish to continue at the new price, you may cancel before the change takes effect.
You may cancel your subscription at any time by contacting us at hello@nevermissamessage.co.uk. There is no notice period and no cancellation fee.
On cancellation, your assistant will be deactivated at the end of your current billing period. You will not be charged for subsequent months.
The setup fee is non-refundable.

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.
Customer enquiry data (name, job description, location) is stored on our servers and delivered to you via WhatsApp. You are responsible for handling that customer data in accordance with UK GDPR and your own privacy obligations as a data controller.
The Service is provided “as is”. While we take care to configure your assistant accurately, AI systems can occasionally produce unexpected outputs. We do not guarantee that the assistant will capture every enquiry or that all responses will be perfect.
To the maximum extent permitted by law, our total liability to you in connection with the Service shall not exceed the total fees paid by you in the three months preceding the event giving rise to the claim.
We are not liable for any lost revenue, lost customers, or indirect losses arising from your use of or inability to use the Service.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
We aim to maintain high availability of the Service but do not guarantee uninterrupted operation. Planned maintenance will be carried out with reasonable notice where possible. We are not liable for downtime caused by third-party services (including WhatsApp, Twilio, or our cloud infrastructure provider).
We reserve the right to suspend or terminate your account if you breach these Terms, provide false information, or use the Service in a way that causes harm to others or brings the Service into disrepute. In such cases we will give you notice except where immediate action is required.
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We may update these Terms from time to time. We will notify active subscribers of material changes by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
